These terms may be changed at any time, and the last change date listed at the top of the terms serves as notification of these changes.
RTrack ("RTrack", "the website", "our website"), the services, and the products it provides are provided by RTrack Data Ltd ("we", "RTrack Data Ltd", "us", "RTrack", "the Owner" and "SteadyOn"), a registered private limited company in the United Kingdom. Company number: 12429215. In this agreement, "Membership" or "RTrack membership" or "Plan" refers to any product or service that is offered by RTrack in return for payment (Including, but not limited to: "RTrack Basic", "RTrack Pro", "RTrack Complete", "RTrack Enterprise"). This includes products or services that have been provided to you free of charge, but are also available for purchase, this includes, but is not limited to: RTrack membership given free of charge by us at our discretion.
All materials, visualisations and data published on or used on RTrack are protected by copyright, and are owned by the site operator, RTrack Data Ltd, or in some cases, the entity listed as the copyright holder of the materials. RTrack does not claim to own the copyright of game names, descriptions, thumbnails or any intellectual property of game creators that is displayed on RTrack. UNAUTHORIZED COPYING, REPRODUCTION, UPLOADING, STORAGE, POSTING, TRANSMITTING, REPUBLISHING, DISTRIBUTING OR DUPLICATING OF ANY OF OUR COPYRIGHTED MATERIAL IS PROHIBITED. Use of our services does not give you control over any of RTrack's intellectual property and provides you no intellectual property rights. The data and materials provided by RTrack is our intellectual property and we do not give permission for it's use unless our express permission is given.
We reserve the right to suspend or restrict access to our website, to areas of our website and/or to functionality upon our website. We may, for example, suspend access to the website [during server maintenance or when we update the website]. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the website.
You agree not to use RTrack in any way or take any action that causes, or may cause, damage to the website or impairment of the performance, availability, accessibility, integrity or security of the website.
You agree not to use RTrack in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You agree not to probe, scan, or otherwise search for vulnerabilities on RTrack without our express permission to do so.
You agree not to use any data collected from RTrack for marketing of any kind.
You agree not to copy any data in text or file form from RTrack, and additionally, that you will not store, download, distribute or upload any text or files containing data from RTrack.
The products and services provided by RTrack are provided 'as available' and 'as is'. To the extent permitted by law, we make no guarantees that they are safe or secure, that they will function without errors, delays or disruptions.
To the fullest extent permitted by applicable law, RTrack takes no liability for any financial losses, lost profits, lost revenues, lost data, fines and consequential, special, indirect, exemplary, punitive or incidental damages arising out of or related to RTrack's products and services.
Making requests to non-public or non publicised endpoints for any reason, including data collection is against these terms. RTrack memberships do not include any permission to collect data from RTrack programatically, or through any means that is not by a human on a web interface/browser. By using RTrack and agreeing to these terms, you accept that if you make direct web requests to endpoints not listed on either: gamestats.rtrack.live or RapidAPI, RTrack reserves the right to remove any access you hold without a refund, and block you from using the service. You agree not to scrape, store or share any data from RTrack, and you agree that no RTrack data may be re-sold, or shared. RTrack reserves the right to seek damages for data collected or shared, to the greatest extent permitted by applicable law. RTrack does not permit, or give permission for automated data collection on any API endpoints unless shown on the gamestats.rtrack.live documentation page, or on RapidAPI.
RTrack Enterprise is a membership plan available to RTrack users that provides access to various platform wide statistics.
Access to this data is provided to the individual who registered the RTrack account on which access is granted ("Customer Seat", "The Customer").
"Permitted Purposes" means the Customer Group’s access and use of the Platform and RTrack Data solely to support the Customer’s lawful business purposes, and in particular pertaining to the production of internal presentations and reports which shall be kept confidential to the Customer Seat.
"Customer Group" means the Customer and its employees (including the Customer Seats);
"Platform" means the interface by which Access is possible, as modified or replaced by the Supplier from time to time;
1.1 The Customer acknowledges that the Platform and RTrack Data have not been prepared to meet the Customer's individual requirements and that it is the responsibility of the Customer to ensure that the Platform and RTrack Data meet its requirements.
1.2 The Customer warrants that it shall not disclose details of the Platform to persons other than the Customer Seat.
1.3 The Customer acknowledges that RTrack is only granting Access on the basis of the Permitted Purposes, and Access by it or any person acting on its behalf for reasons outside the scope of the Permitted Purposes will constitute a breach of the Agreement.
1.4 RTrack grants to the Customer an exclusive, non-transferable licence to use RTrack Data for the Permitted Purposes for the duration of the Agreed Period.
1.5 The Customer shall ensure that Access is restricted to the Customer Seats. The Customer shall not, without the prior written consent of RTrack, permit persons other than the Customer Seat to have Access, or effect any changes to the Customer Seat. For the avoidance of doubt, RTrack may require the Customer to pay a reasonable charge for giving consent to changes affecting the Customer Seats and shall not be deemed to have acted unreasonably if consent is withheld.
1.6 The Customer Seats may download RTrack Data from the Platform and make as many copies of the RTrack Data as are reasonably necessary for the Customer's ordinary use of RTrack Data for Permitted Purposes. Save as provided in clause 2.1 below, the Customer Seats are not permitted to share, distribute, or otherwise allow any other persons to have access to, copies of RTrack Data. These copies are subject to the terms and conditions of this Agreement. Where applicable, the Customer shall ensure that all of the Supplier's trademarks and copyright and restricted rights notices are reproduced on these copies.
2.1 The Customer may permit other members of the Customer Group to use copies of RTrack Data to create Derivative Products for Permitted Purposes. If the Customer permits these persons to do so, the restrictions on use and copying of RTrack Data set out in this Agreement shall apply to those persons. The Customer shall ensure that these persons comply with those restrictions.
2.2 Except as provided in clauses 1 and 2, the Customer shall not, without the prior written consent of the Supplier:
market, exploit or make RTrack Data available to another person or permit another person to use RTrack Data or copies of it;
use RTrack Data on behalf of or for the benefit of another person;
decompile or disassemble the program code or any other part of the Platform or RTrack Data except to the extent permitted at law;
make copies of RTrack Data;
charge or otherwise deal in or encumber RTrack Data; or
delete, remove or in any way obscure the Supplier's proprietary notices on any copy of RTrack Data.
2.3 RTrack warrants that it has full right and authority to grant the licence set out in clause 2.
